Posted By Herman Martinez || 25-May-2009 I was in a Criminal Defense seminar for couple of days and during one of the ethics portions of the seminar I could not believe my ears. Someone posed the following question: what if someone wants to see there mental health report, but it contains a lot of negative remarks about my client? I am paraphrasing the question. The speaker responded that initially she would try to divert her client's attention from the question. She would ask another question or get her client off topic so they would forget the question. Candidly, I was floored! As a client you are entitled to all court records regardless if they are in your favor or not. Keep in mind that the court files are open to the public not only you.
