Administrative License Revocation Hearings

You have 15 days to fight your license suspension!

Many people who are arrested for driving while intoxicated (DWI) have had their driver’s licenses suspended and have done nothing about it. Most likely, this is because they did not know that they had any other option. There is a way to be granted restricted driving privileges after a DWI arrest, however, and that is by requesting an Administrative License Revocation (ALR) hearing. This hearing must be requested within 15 days of your arrest, or else your license will be suspended. The person making the request will then be notified of the location, date, and time of the hearing. ALR hearings can be conducted via telephone, but the most common choice is an in-person hearing held at a State Office of Administrative Hearings (SOAH).
ALR hearings are not conducted like general criminal proceedings. Each hearing is presided over by an administrative law judge (ALJ) who is not necessarily trained in each of the laws regarding DWI or your arrest. There is no jury, either. As a result, ALR hearings can often be “one-sided” and very difficult to win. The better your defense, the higher chance you have of convincing the ALJ to give you a good recommendation, lowering or dismissing your charges and allowing you to maintain driving privileges. Having a skilled Houston DWI lawyer to represent you can make all the difference in an ALR hearing, because they will know they laws and have experience with proper ALR hearing procedures. So in order to make sure that you are able to keep at least some of your independence, hire a criminal defense lawyer who can represent you at your ALR hearing.
